These terms are an agreement between you and the developer of Early Days, who does business as Huhu ("Huhu", "we", "us") — an independent developer based in California, USA. By creating an account or using the app you accept them. If you got the app from Apple's App Store, the "App Store" section below is also part of this agreement.
Early Days is a tool for parents and caregivers to record and organize information about their baby's care — feeding, sleep, diapers, medicines, growth — and to share those records within their own family, with optional reminders, pattern summaries, a white-noise player, and a device-to-device baby monitor.
You must be at least 18 and legally able to enter this agreement. Accounts are for adults; the app is not directed to children and children may not use it.
We give you a personal, limited, non-exclusive, non-transferable license to use Early Days on Apple-branded devices you own or control, as the App Store rules allow, for your family's own non-commercial use. Don't copy, resell, or redistribute the app, and don't reverse-engineer it except where the law says we can't stop you.
EARLY DAYS IS AN INFORMATION AND RECORD-KEEPING TOOL ONLY. IT IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.
The monitor feature connects your own devices over your own network. It is a convenience, NOT A MEDICAL OR SAFETY DEVICE AND NOT A SUBSTITUTE FOR ADULT SUPERVISION. Audio/video can be interrupted at any time — by network conditions, device sleep, battery, backgrounding, or app termination — and you may receive no warning that the connection has dropped. The app cannot guarantee you will hear or see your child. NEVER RELY ON THE MONITOR AS YOUR ONLY WAY OF CHECKING ON A CHILD, AND NEVER USE IT IN ANY SITUATION WHERE A MISSED SOUND OR IMAGE COULD RESULT IN HARM.
The records you enter belong to you. You give us the limited license needed to store, process, and display them to you and your invited family members — that's the whole purpose — and nothing more. Export and deletion controls are in Settings.
Keep your account secure. Only invite caregivers you trust — they will see your baby's records and can add their own. You're responsible for the accuracy of what you enter and for how you use it. Use the app lawfully, don't abuse or overload the service, and don't use the monitor to observe anyone without the consent the law requires where you are.
The app is provided free of charge today. We work hard to keep it reliable, but — and this is the legally operative part, so it's in capitals:
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT REMINDERS, NUDGES, OR THE MONITOR WILL ALWAYS WORK.
Some places don't allow some of these exclusions, so parts may not apply to you. We may change, suspend, or discontinue features; we'll be decent about it — export stays available before any shutdown of the service so you can take your data with you.
To the maximum extent permitted by law, Huhu will not be liable for indirect, incidental, special, consequential, or exemplary damages, or for loss of data, arising from your use of the app. To the maximum extent permitted by law, our total liability for any claim relating to the app is limited to the greater of the amount you paid us in the past 12 months and US $50.
Two honest carve-outs: nothing in these terms limits or excludes liability for our fraud, willful misconduct, or gross negligence, or any other liability that cannot lawfully be limited (some jurisdictions do not allow limits on certain damages, so parts of this section may not apply to you). And nothing in these terms takes away consumer rights the law gives you that can't be waived by contract.
You can stop using the app and delete your account at any time in Settings. We may suspend or terminate accounts that abuse the service or break these terms; if we do, you can still export your data first unless the law prevents it.
We may update these terms; if we make material changes we'll tell you in the app before they take effect. Using the app after changes take effect means you accept them. If you don't accept them, stop using the app and delete your account.
These terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in California, and you and we consent to their jurisdiction — except that either of us can use small claims court where you live if the claim qualifies, and nothing here takes away protections the consumer-protection law of your home jurisdiction gives you that can't be waived. Before filing anything, contact us — most issues can be fixed by email: app_support@meethuhu.com. There is no arbitration clause in these terms; if we ever add one, that would be a material change under Section 11.
Because you get Early Days through Apple's App Store, Apple requires this agreement to include the following — all of it is true and we state it plainly:
If any part of these terms is found unenforceable, the rest still stands. These terms (plus the Privacy Policy) are the whole agreement between us about the app. If we don't enforce a term at some point, we haven't waived it. You may not assign this agreement; we may assign it to a successor who takes over the app — with your data protected as the Privacy Policy promises.
