Gather

Terms of Use

Effective date: 2 October 2026

These terms are an agreement between you and Huhu Inc. ("Huhu", "we", "us"), the developer of Gather, based in California, USA. By creating an account or using the app you accept them. If you got the app from Apple's App Store, the "App Store" section below is also part of this agreement.

1. The service

Gather helps families plan together: a shared family calendar; importing events and camps from emails, photos and schedules; saving ideas and places; finding times that work across families; sending time options to anyone by link; connecting with other families; group chat; and optional connections to AI assistants you already use.

2. Who may use it

You must be at least 18 and legally able to enter this agreement. Accounts are for adults; the app is not directed to children and children may not use it. You are responsible for everyone you add to your family account.

3. Your license to use the app

We give you a personal, limited, non-exclusive, non-transferable license to use Gather on Apple-branded devices you own or control, as the App Store rules allow, for your family's own non-commercial use. Don't copy, resell, or redistribute the app, and don't reverse-engineer it except where the law says we can't stop you.

4. THE AI FEATURES ARE ASSISTANTS, NOT AUTHORITIES — READ THIS

GATHER USES AUTOMATED AI TO READ EMAILS, PHOTOS, AND SCHEDULES, AND YOU CAN CONNECT AI ASSISTANTS THAT DRAFT PLANS. AI OUTPUT CAN BE WRONG, INCOMPLETE, OR OUT OF DATE.

5. SHARING IS PERMANENT-ISH — READ THIS

Gather is built for sharing, and sharing has consequences you should understand before you use it:

6. Your content

The events, messages, photos, and ideas you enter belong to you. You give us the limited license needed to store, process, and display them to you and the people you choose to share with, and to send them through the third-party services described in the Privacy Policy (hosting, email delivery, and AI processing) — that's the whole purpose, and nothing more.

7. Information about other people

Gather lets you enter information about people who don't use it — guests you invite, families on a class roster you upload, senders of emails you forward. You are responsible for having the right to share that information with us, for only inviting people you actually know, and for complying with any rules your school, club, or organization has about its directory. Don't upload a roster you were told not to share. If someone asks us to remove information about them that you provided, we will remove it.

8. Your responsibilities

Keep your account secure. Use the app lawfully. Don't harass anyone, don't post content that is illegal, abusive, or infringes someone else's rights, don't impersonate anyone, and don't abuse or overload the service or try to access data that isn't yours. You're responsible for the accuracy of what you enter and for how you use it. We may remove content or suspend accounts that break these rules.

9. Availability; NO WARRANTY

The app is provided free of charge today. We work hard to keep it reliable, but — and this is the legally operative part, so it's in capitals:

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, THAT NOTIFICATIONS OR REMINDERS WILL ALWAYS BE DELIVERED, THAT EVENTS EXTRACTED FROM EMAILS, PHOTOS, OR SCHEDULES WILL BE ACCURATE, OR THAT AVAILABILITY, FREE/BUSY TIMES OR SUGGESTED TIMES ARE ACCURATE OR CURRENT.

Some places don't allow some of these exclusions, so parts may not apply to you. We may change, suspend, or discontinue features; we'll be decent about it and give you a way to get your data before any shutdown of the service.

10. Limitation of liability

To the maximum extent permitted by law, Huhu will not be liable for indirect, incidental, special, consequential, or exemplary damages, or for loss of data, arising from your use of the app — including anything arising from a missed or inaccurate reminder, a mis-parsed event, or content shared with someone you didn't intend. To the maximum extent permitted by law, our total liability for any claim relating to the app is limited to the greater of the amount you paid us in the past 12 months and US $50.

Two honest carve-outs: nothing in these terms limits or excludes liability for our fraud, willful misconduct, or gross negligence, or any other liability that cannot lawfully be limited (some jurisdictions do not allow limits on certain damages, so parts of this section may not apply to you). And nothing in these terms takes away consumer rights the law gives you that can't be waived by contract.

11. Termination

You can stop using the app and delete your account at any time in Settings. We may suspend or terminate accounts that abuse the service or break these terms; if we do, you can still ask for your data first unless the law prevents it.

12. Changes

We may update these terms; if we make material changes we'll tell you in the app before they take effect. Using the app after changes take effect means you accept them. If you don't accept them, stop using the app and delete your account.

13. Governing law and disputes

These terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in California, and you and we consent to their jurisdiction — except that either of us can use small claims court where you live if the claim qualifies, and nothing here takes away protections the consumer-protection law of your home jurisdiction gives you that can't be waived. Before filing anything, contact us — most issues can be fixed by email: app_support@meethuhu.com. There is no arbitration clause in these terms; if we ever add one, that would be a material change under Section 12.

14. App Store (Apple) terms

Because you get Gather through Apple's App Store, Apple requires this agreement to include the following — all of it is true and we state it plainly:

15. The paperwork clauses

If any part of these terms is found unenforceable, the rest still stands. These terms (plus the Privacy Policy) are the whole agreement between us about the app. If we don't enforce a term at some point, we haven't waived it. You may not assign this agreement; we may assign it to a successor who takes over the app — with your data protected as the Privacy Policy promises.
